1.Agreement to Terms
The following terms and conditions apply to the business relationship between ‘’us’’, the ‘’Home Town Media GmbH’’ respectively ‘’keepviennaboring.at’’ and ‘’you’’ our customers, guests and subscribers. Home Town Media GmbH is a company registered in Vienna, Austria.
2. Subscription Terms
Home Town Media GmbH offers three types of subscriptions:
The digital subscription, which includes the digital version of the magazine, access to premium content on the website, digital access to our archive, invitations to our subscriber-only events, our weekly newsletter “Your Guide to Austria’s Latest News” and access to our subscriber-only special offers and sweepstakes
The print and digital subscription, which includes 4 print issues of Metropole and free access to all our events, in addition to the benefits of the digital subscription.
The Metropole group subscription, which includes all of the benefits above, plus exclusive offers and discounts from our partners, a free Metropole Survival Kit, invitations to exclusive partner events, dining and entertainment experiences in Vienna and gifts at every renewal.
3. Other Products
Besides the subscriptions, we offer other products such as books and posters on Metropole.at.
The books are being published by our media house ‘’Home Town Media’’. You can order the books online and either choose between delivery and pick up. We also sell the books at our Metropole Events.
In our webshop you can order Cover Posters, they cannot be delivered, but you can come to our office to pick them up.
4. Right of Withdrawal
Subscription contracts that have been completed online can be cancelled within fourteen days without giving reasons. The cancellation period for digital subscriptions is fourteen days from the day you have access to your subscription. Print and Digital Subscriptions can be cancelled within fourteen days after receiving your first copy. You do not have to return the magazines you have already received. In case you want to return them it is at your expense. These cancellation conditions do not apply to subscription renewals, the renewal payments can not be refunded.
Books that have been bought online and have been delivered to you by us can be returned within fourteen days without giving reasons. The fourteen day period starts when you have received the books. To withdraw from the purchase you will have to return the books to us at your expense.
The right to withdrawal does not apply to products that are sold as part of our events or have been picked up directly at our office.
If you justifiably withdraw from the contract, we will reimburse all payments made using the same means of payment that were used when concluding the contract, at the latest within 14 days of receipt of the notice of withdrawal.
5. Pricing and Payment Methods
5.1 Pricing
Prices displayed on the subscription page of the website will prevail at all times in relation to orders placed online. Prices quoted on screen include delivery charges and taxes (where applicable). All credit cards will be debited in euros by your bank on behalf of Home Town Media GmbH.
Each subscription package will be billed in one installment.
Although we try to ensure that all prices are accurate, errors may occur. If we discover an error in the price of your order, we will inform you as soon as possible. You will have the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you, we will treat the order as canceled. We will refund you in full if you cancel or have already paid.
When you subscribe to Metropole, you are charged the current subscription price for the respective subscription period, after which the subscription is automatically renewed for the same period. The subscription fee is charged immediately. In the event of price adjustments during the subscription period, the subscription price at the time of renewal will be charged for the next invoicing period.
If you are under 18 or are not using your own credit card to pay for the subscription, you must ask the permission of the credit card holder before entering the payment details. By clicking “Submit” you are confirming that you have obtained the express prior permission of the credit card holder.
5.2 Payment Methods
SEPA Direct Debit
Sepa Direct Debit only applies to Countries within the European Union.
By paying by SEPA direct debit, you instruct Home Town Media GmbH to deduct the invoiced amount from your account by means of a recurring SEPA direct debit. You are thereby authorizing your bank to issue the direct debits. Your bank is also authorized to retract direct debits, particularly if the account does not have the required funds. You can revoke the SEPA mandate at any time by cancelling your subscription or switching your payment method. You will be informed about the amount and debit dates accordingly and forego a corresponding pre-notification before making the direct debits.
Credit Card & PayPal
By entering your credit card details into the “My Account” page, the credit card processor Stripe will collect the invoiced amount. If you choose PayPal as your payment method, please make sure that your account is linked to a credit card or that you have sufficient funds. In both cases, Home Town Media GmbH will not save your credit card information. Only the payment processor Stripe or PayPal will collect credit card information. We will not share your name, address, e-mail address or any other personal information with third parties.
6. Newsletter
There are three different newsletters you can sign up for:
- Our monthly newsletter provides you with an overview of what’s happening in Vienna this month, including invitations to our Metropole events. You are signed up for this newsletter when you buy something in our online shop, register for events or subscribe to our Newsletter directly on our website. (keepviennaboring.at/newsletter)
- If you have a Metropole subscription, no matter if it’s a group subscription, a print & digital subscription or digital only, you will receive our weekly newsletter “Your Guide to Austria’s Latest News” with updates on our latest articles and current events.
- Our Metropole Members will additionally receive exclusive Member Zone updates once a month.
You can unsubscribe from any of the newsletters at any time using the “unsubscribe” link at the bottom of each email.
7. Metropole Account
In your Metropole account you can view your recent orders, change or cancel your subscription and edit your personal information, in particular your name, email address, shipping or billing address, payment details and your password. As soon as you log in to your Metropole account, you will have access to all Metropole premium content, which is only visible for subscribers.
8. Delivery
8.1 Magazine Delivery
Metropole magazines are delivered via the Austrian postal service during the first week of the month of publication (March, June, September, December), four times a year.
We deliver Metropole to the address you provided when placing your order. Subscriptions start with immediate premium online access and the next available print issue. If you have supplied us with an incorrect address, we are not responsible for failed deliveries. We reserve the right to dispose of incorrectly addressed envelopes and their contents without an obligation to refund you or any other person if they are returned to us.
If you order before the 20th of the month prior to magazine delivery: February 20th, May 20th, August 20th or November 20th, you will receive the following print issue. Any orders made after the 20th of the month will begin one cycle later. For example, an order made on May 9 will begin with the Summer issue (delivered in the beginning of June), however an order made on May 26 will begin with the fall issue, delivered in September.
8.2 Digital
Subscribers receive digital access immediately upon completing the order. The current issue (as well as the entire archive of past issues) is accessible in ePaper format and as individual articles anywhere in the world.
8.3 Books and Posters
Books purchased are delivered to you via the Austrian postal service. In the Metropole shop you also have the option to pick orders up at our office at Praterstraße 1/2/25, 1020 Vienna. By choosing office pick-up, no shipping costs will be charged and you have no right to return. Posters can be bought online, but only be picked up at our office.
9. Liability
Home Town Media is not liable for any delay in delivery or non-delivery of magazines under the following circumstances:
- If the payment card issuer or bank refuses to authorize payment to us;
- If such delay or failure is due to circumstances beyond our control or the control of our subcontractors and agents, including but not restricted to war, electricity power failure, utilities failure, failure of telecommunications links, failure of transport infrastructure, fire, flood, government act, an act of God, legislative constraints, strikes, labor disputes or malicious damage involving employees.
Our liability to you in the event of magazines being lost in dispatch shall be at our discretion be limited either to replacement of the missing issues or refund of the cost of the missing issues, to the extent permitted by law we exclude all other liability to you. Our exclusions of liability shall not apply to any damages arising from death or personal injury caused by our negligence or that of any of our employees or agents. These terms and conditions do not and shall not affect your statutory rights as a consumer.
We will not be responsible if you fail to receive the written confirmation because you have supplied us with an incorrect postal or e-mail address. We reserve the right not to accept or process your order for any reason. All orders are subject to validation checks and authorization by your payment card issuer. If we cannot accept your order and your credit card has already been debited, we will notify you and refund your card in full immediately.
10. Warranty
If the delivered goods are defective, general Austrian warranty rights apply.
11. Copyrights
As a private subscriber, you do not have the right to copy Metropole magazine or the contents thereof for any purposes. An educator may copy Metropole for educational purposes only, after requesting permission in writing. The copyrights for one subscription apply to one educator only. A school must purchase one subscription per educator using Metropole in their classes.
You agree not to archive, reproduce, distribute, modify, publicly perform, publish, license, create derivative works from or offer for sale, content and information contained on or obtained from or through Metropole. We may terminate or restrict your use of our service if you violate the copyright of these Terms and Conditions or are engaged in illegal or fraudulent use of the service.
12. Events
Tickets to Metropole Salons and Special Events can be purchased on our website. These tickets are free of charge for Metropole Club members as well as for Print & Digital subscribers.
By attending our events you automatically agree to Metropole taking pictures and/or making video recordings of you during the event and publishing them free of charge on their website or in other media (TV, print, online) for the purpose of presenting the event and its participants, including in press coverage and documenting the event.
Pictures/video recordings may not be used (without charge) for any purpose other than those described. Metropole will not share any pictures and/or video recordings of you with third parties. You also agree that your personal data may be saved for the purpose of processing; to provide you with information on further activities and events of Metropole.
Your consent is voluntary, and you will not experience any disadvantages if you choose to withhold it. You can revoke your consent at any time by sending an email to salon@keepviennaboring.at.
13. Personal information
We may only use your personal information as set out in our Privacy Policy.
14. Welcome Gifts and Promotions
If the subscription offer includes a welcome gift voucher or promotion coupon, this is subject to availability and will be delivered separately after your first payment. Home Town Media GmbH reserves the right to supply an alternative gift of the same or higher value if the intended gift is not available. Gifts are only available to subscribers residing in Austria.
15. Applicable law / place of jurisdiction
These terms and conditions are subject exclusively to Austrian law. The court whose jurisdiction is the place of residence, habitual residence or place of employment of the customer is responsible for any legal disputes.
16. Severability clause, written form
Should individual provisions of these terms and conditions be or become wholly or partially ineffective or void, this does not affect the effectiveness of the remaining terms and conditions. Existing statutory provisions replace any ineffective or void provisions.
Changes or additions to these terms and conditions must be made in written form.
